1. Who we are, and what this is

Play Cards Live and the games within it — including Wild Hand & Foot — are owned and operated by Joslin Studios LLC, an Arizona limited liability company ("Joslin Studios", "we", "us", "our").

These Terms are an agreement between you and Joslin Studios LLC. By creating an account or playing, you accept them. If you do not accept them, do not use Play Cards Live.

2. You must be 18

You must be at least 18 years old to use Play Cards Live. By using it you confirm that you are, and that you are legally able to enter into this agreement.

3. Your account

You need an account to play. You agree to give accurate information when you register, to keep your password to yourself, and to tell us promptly at [email protected] if you think someone else has got into your account.

One account per person. You are responsible for everything that happens under your account.

You may delete your account at any time. Deleting your account forfeits any remaining credit balance, which has no cash value (see §5).

4. Fair play

Play Cards Live is a game people play against each other, and it only works if everyone plays it straight. You agree not to:

modify, reverse-engineer, decompile or tamper with the game or its network traffic;
use bots, scripts, automation or any tool that plays for you or reveals information you are not meant to see;
exploit a bug rather than reporting it, or attempt to gain credits by any means other than playing and purchasing;
collude with another player against the others at a table, or play multiple accounts at one table;
harass, threaten, impersonate or abuse other players, or post unlawful, hateful or obscene content in chat;
disrupt or overload our servers, or attempt to gain unauthorised access to any part of the service.

If you find a security flaw or an exploit, please tell us at [email protected] rather than using it. We would much rather fix it, and we will not pursue anyone who reports a problem in good faith and does not exploit it.

We may suspend or terminate an account that breaks these rules, and we may remove chat messages or mute chat privileges. Where a decision is significant and the circumstances allow, we will tell you why.

5. Credits — no cash value, no payouts

This is the most important section of these Terms. Please read it.

Credits are a virtual in-game currency. They are a licence to use a feature of the game, and nothing more.

Credits have no cash value.
Credits cannot be exchanged, redeemed or cashed out for money, goods, or prizes — from us or from anyone else.
Credits cannot be sold, traded or transferred to another player or to anyone outside the game.
Credits are not a deposit, not a stored-value instrument, not property, and not a currency.
We may change, devalue, expire or discontinue credits, and we may adjust prices, stakes and game rules, at any time.

Play Cards Live does not offer gambling. No real money is ever won, and no real money is ever paid out. Buying credits is a purchase of a game feature that is consumed by playing, in the same way as any other in-app purchase. Winning a game returns credits to your in-game balance and nothing else.

How a game settles. When a match is dealt, each human player's stake is taken from their balance into the match. At the end, the winning side receives the pot less a 5% service fee retained by Joslin Studios LLC. Players who abandon a match in progress may lose their stake and be charged an additional penalty. These amounts are shown in the game before you sit down, and are subject to change.

6. Purchases and refunds

Credits are sold through the app store you installed the game from — currently Google Play. Your purchase is a transaction with that store, and their refund policy governs it, not ours. Google Play's refund terms are available in the Google Play Store.

Credits are delivered immediately and consumed by playing, so once they have been spent in a game they cannot be restored. If a purchase fails to arrive, or credits are lost through a fault of ours, contact [email protected] and we will make it right.

We may offer promotional credits at our discretion. Promotional credits may expire and are subject to this whole section.

7. Our content, and yours

Play Cards Live, its artwork, its software, its name and its logos are owned by Joslin Studios LLC and protected by copyright and trade mark law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the game for your own entertainment. You may not copy, distribute, sell, rent, or create derivative works from it.

You keep ownership of what you write in chat. By sending it, you grant us the right to transmit, store and display it as part of running the service, and to review or remove it under §4.

Hand & Foot and canasta are traditional card games in the public domain. Our particular rules, software, artwork and presentation are ours.

8. The service may change or go down

We are a small studio and Play Cards Live is under active development. We may change, suspend or discontinue any part of it — including a game, a feature, or the service as a whole — at any time.

We aim to keep it running but we do not guarantee uninterrupted or error-free service. Games may be interrupted by maintenance, by faults, by your own connection, or by another player disconnecting. Where a fault of ours causes you to lose credits, contact support and we will correct your balance. We are not responsible for losses caused by your own internet connection or device.

9. Disclaimers

To the fullest extent permitted by law, Play Cards Live is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Joslin Studios LLC will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or lost credits.

Our total liability to you for any claim relating to Play Cards Live will not exceed the total amount you paid us in the 12 months before the claim arose. If you have not paid us anything in that period, our liability is limited to the smallest amount permitted by applicable law.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the above applies to you only to the extent permitted, and nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

11. Indemnity

You agree to indemnify Joslin Studios LLC against claims, damages and reasonable legal costs arising from your breach of these Terms or your misuse of the service.

12. Termination

You may stop using Play Cards Live and delete your account at any time.

We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if we discontinue the service. If we terminate your account for a breach of §4 (Fair play), any remaining credit balance is forfeited. If we discontinue the service entirely, we will give reasonable notice where we can.

Sections 5, 7, 9, 10, 11 and 13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. You and Joslin Studios LLC agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona, except that either party may seek relief in any court of competent jurisdiction to protect its intellectual property.

Please contact us first. Most problems are a misunderstanding or a bug, and [email protected] will get to a person who can fix it faster than a court will.

14. General

If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor to our business. These Terms, together with the Privacy Policy, are the entire agreement between you and Joslin Studios LLC about Play Cards Live.

15. Changes to these Terms

We may update these Terms. We will update the date at the top, and for changes that materially affect your rights we will notify you in the app or by email before they take effect. Continuing to play after a change takes effect means you accept it.
